This Watercraft Rental Agreement is made by and between Sioux Area Ryderz, LLC, 2406 W. Madison Street, Sioux Falls, S.D. 57104 (“Ryderz”) and the following individual (“Renter”):

Ryderz agrees to provide for the use of Renter the following described watercraft on the terms set out in this Agreement:
Watercraft
1.Price and Payment. Renter shall pay to Ryderz the total amount of $
for the use of the Waterdraft. This total includes sales tax, fuel, and the use of related safety equipment. The Price shall be paid in advance and is non-refundable in whole or in part immediately upon delivery of the Watercraft to Renter.
2. Deposit. Renter shall pay to Ryderz a refundable deposit in the total amount of $
The deposit will be refunded to Renter within 24 hours of the return of the Watercraft by Renter less the amount of any repairs or replacement or additional rental charges.
3. Delivery. Ryderz shall deliver the Watercraft to Renter at the following location:

The Price is fully earned by Ryderz upon delivery whether Renter appears to accept the delivery or not. Ryderz will wait for Renter at the delivery location for 30 minutes. Renter shall inspect the Watercraft on delivery and accepts that the Watercraft is in good condition unless Renter sends a detailed message to Ryderz within 15 minutes of delivery. Renter shall return the Watercraft to Ryderz in good and workable condition without any damage.
4. Duration of the Rental Period. The Rental Period is
hours after the time set forth above for delivery. Renter shall return the Watercraft to the Delivery location at the end of the Rental Period. Renter shall pay to Ryderz an additional rental charge equal to the Price if the Watercraft is not returned in time as an additional rental charge. If the Watercraft is not returned within this extended Rental Period it will be deemed stolen and reported as such to law enforcement.
5. Renter Representations. Renter acknowledges that use of the Watercraft can result in injury or death, represents that Renter is familiar with use of the Watercraft and is sufficiently skilled in its proper use, hereby waives all claims against Ryderz and its agents arising out of or relating to Renter’s use of the Watercraft other than intentional wrongful acts of Ryderz or its agents, and hereby agrees to indemnify, defend, and hold harmless Ryderz and its agents from all claims arising out of or relating to Renter’s use of the Watercraft or this Agreement. Renter agrees to abide by all the terms of use as set forth on Ryderz website at:
6. Limitation of Liability. Renter hereby agrees that the maximum liability for Ryderz and its agents combined is limited to the lesser of ten times the Price or the available limits of liability insurance.
7. Not a Sale. This is a rental agreement and not a sale agreement. No watercraft or safety equipment is being sold, and Ryderz retains all ownership interests.
8. Merger and No Oral Modifications. All prior discussions are hereby voided and all agreements and representations are as set forth in this Agreement. All modifications to this Agreement must be in writing to be enforceable.
9. Disputes. All disputes arising out of or relating to this Agreement shall be resolved by arbitration administered by the American Arbitration Association, and each party waives the right to trial by jury and any adjudication by a court. Each party shall pay its own costs and attorneys’ fees.
